100% yes if it's your spouse's separate property acquired prior to your marriage. If it's community property acquired during your marriage, it will need to be listed as a community asset in your bankruptcy filing. He/she will most likely be able to keep it if it's covered under the exemption statute in your bankruptcy filing.
