If the house is surrendered in a Chapter 7 bankruptcy, a debtor will have 60 days from the day the title is transferred back to the bank to move, which in most cases, can be many months before the title is transferred back to the bank. If a debtor continues to stay current on the mortgage payments, then the house can be kept even in a Chapter 7 bankruptcy without the need to move.
